incredibly immoral. Our entire system is at risk of we allow public pressure and that to control how juries vote. And it makes the defense attorney look incompetent. No idea why he's pushing this jury stuff. Bro, it's your job to figure this shit out and strike him before the trial if this is the case. Right or wrong decision, this witch hunt is wrong.

The problem is that they should be allowed to near legal precedings. We want the public to be able to see what is happening at the moment with our justice system both to get a better understanding of how it works in case they need to use it, but also see what decisions are being made (that could be directly influencing laws or how the rules of society are treated) in real time. This also does some to prevent any abuse of power by a judge or lawyer in the courtroom, because anyone could be watching. The problem, specifically with the two cases you’ve brought up, are they did not stay as available to the public just for general information and accessibility to the legal system, but became that media circus and was detrimental to all involved. I’m not sure how you could ensure trials stay public, but not go this far.

Going this far is pretty much inevitable once any case garners and sustains widespread attention in our current culture.

Either culture has to change drastically, or we need to accept that the media being involved in criminal cases while it is happening isn't compatible with the principles of justice and the rule of law anymore.

Like have all the jurors in a back room and all information about each trial be given out in dossiers with all identifying personal info blacked out. Never any face to face interactions. Then as proceedings occur and are put into transcript, have the jurors be reading the live update on a screen. Any images put forth by either side as evidence be revealed to the jurors in real time next to the simultaneously updating transcript of whatever the witnesses are saying. And if jurors are vision impaired, then the transcript can be read out loud by an automated robot voice.

I feel like this is low key jury intimidation. No other jurors are getting this treatment. It feels like a message is being sent by the media that you have give the verdict we want, otherwise we will dig through background, interview everyone that knows you and then find something to nationally embarrass you.

No, but their names and even addresses are a matter of public record in Massachusetts.

'[T]he identities of jurors empanelled to serve at criminal trials are presumptively public under long-standing Massachusetts law, practice, and tradition.’ Commonwealth v. Fujita, 470 Mass. 484, 486 (2015). By statute, this information is public record, and the lists ‘contain[ing] the name, address, and date of birth of each juror … shall be available upon request for inspection by parties, counsel, their agents, and members of the public.’

There is technically an exemption for potential harm to the jurors, but it is rarely granted. That it was granted in the case of Karen Read upset a lot of people given one of the many bases for this rule (prevention of jury tampering, corruption, or covering up personal familiarity or relationships between jurors and plaintiffs/defendants).

Even when identities are sealed, a fair amount about jurors is often released. The OJ Simpson civil trial is somewhat unusual for having sealed identities in a civil trial, and it has led to one of the most fascinating juror descriptions I have ever read:

Juror 341(Seat 2): A white woman and bank employee who appears to be in her 60s. She wrote on her jury questionnaire that, in her opinion, the use of force in a relationship often predisposes a person to violence. She said she believes Simpson is probably not guilty. She thinks interracial marriages can cause problems. She also said she has no strong feelings about law enforcement, although she said she was "amazed" that former Detective Mark Fuhrman received only probation for felony perjury.

The anti-domestic violence, pro-OJ Simpson acquittal, anti-interracial marriage woman who was estimated to be born in roughly 1935 is a highly unusual combination of beliefs. Close second is this guy:

Juror 326 (Seat 9): A white man in his 50s who believes police are sometimes involved in cover-ups. "Of course they cover up for each other," he said. "It's been done before." He also said it was "possible" that evidence in the case had been tampered with and was doubtful about blood found on a gate at Nicole Brown Simpson's home two months after the murders. He was among the nine criminal trial jurors and eight civil trial jurors who thought that Simpson was less likely to be a murderer because he was a professional athlete.

EDIT: People also very much underestimate how invasive a pre-trial jury questionnaire gets. On the subject of the OJ Simpson trial, that questionnaire has been made public.

In this case the identity of the jurors was supposed to remain anonymous for 14 days, unless the jurors identify themselves. If anything, whichever juror leaked the name to the news station should be held in contempt of court. Even though the news didnt reveal the name, the juror most certainly did.

There is nothing wrong or illegal about researching someone. Prior arrests and such are things you can publicly find and these are open hearing. It is genuinely interesting to know about the people deciding this case especially with all the drama around the lone holdout.

What is immoral is using that as a means to disqualify a qualified juror. There are rules, and assuming the guy was properly vetted, he would qualify as your peer in the “jury of your peers.” You may think you are better than someone for not having committed a crime, but that doesn’t make you any more or less of a peer in the society.

Someone correct me if I’m wrong, but aren’t jurors allowed to vote their conscious? Like the guy is being treated as if he did something illegal, but isn’t this part of the law for this exact reason? Someone’s moral convictions were strong enough to withstand the pressure of the defense and the 11 other jurors. I’m sure you could say oh it’s all for money and attention, but honestly in this case, they all were going to get this attention. We will probably have 4 books come out in the next 2 years about a different juror’s perspective.

There is something morally wrong about journalistic outlets investigating jurors to the extent that they are coming close to outright doxing them.

Jurors are supposed to be anonymous. Just because a couple white women on the jury wanted their 15 minutes of Fame doesn't mean that it's suddenly okay to start doxing everyone else.

Any media outlet disclosing identifying information about a juror beyond the broadest possible demophraphic data honestly should be disallowed from being in the courtroom, as they are a risk to juror safety.

This is a common sentiment in this thread, but as a legal matter, it’s exactly backwards. Court proceedings in the U.S., including the identities of jurors, are generally matters of public record by default. Juries are typically only anonymized in exceptional circumstances.

Yepppp, this is built into the system to prevent punitive action for laws the public doesn't agree with. It's the first time I've seen it used this way though.

i know they screen out jurors who have committed crimes...maybe cause he wasn't convicted? often victims don't pursue legal action to the fullest and drop charges against the offender so they have a clean slate- i know in rape cases jurors are dismissed if they have been SA victims or SA perps (convicted) which is why i think rape trials end in not guilty and light sentencing- most cases are not pursued and victims don't speak out- you weed out all victims (1 in 3 women are victims SA) that leaves a large chance you will have a never convicted rapist as a juror which can sway outcomes.

They are using claims, which can’t be proven since the juror is anonymous, to discredit and slander this individual. This needed to be a fair and just trial, which it has proven not to be. The jury system can't survive if jurors don't remain anonymous, and it can't survive if jurors refuse to do their jobs. A juror's job is to deliberate in good faith.

Moral: this is a jury of her peers and having a violent offender is basically the peer of a child strangling murderer. Maybe this juror also suffers from psychosis and didn’t think Clancy had it based on his experiences? It’s incredibly immoral witch-hunting a juror because he didn’t vote a certain way especially since the court and judge respected his decision. Clancy is getting another trial so why they are attacking this man is ridiculous. If Clancy is innocent by reason of insanity, then she will still get that outcome in the second trial.

I feel like the true start of this misstep is the fact that the jurors have been taking interviews. Idk how this is ok so close to the trial and especially before the next one. This guy was doxxed well before this headline. I tried to look it up and it’s hard to determine how much of that was his doing or not. But once you let that information out…I don’t see how news outlets are that “off” for digging. It seems like the natural chain of events after an initial wrong.
