people are more likely to protect members of their own race, even if they're clearly in the wrong. if it were an all-white jury, she might have gotten through no problem.

I believe his stubbornness has to do with how the trial would go if she were a black woman. More than likely she would go to prison without a second thought, but in this case she could go to a psych ward for life. Which isn’t necessarily better than prison forever, but if thats the reason why he refused to change then it makes sense.

I appreciate the awards yall but this is just me trying to make sense of his position. Do not take it as fact. I’d prefer if we’d focus on fixing the system that has failed so many.

u/NeverNotOnceEver ☑️ 20h ago

While likely true about a black woman being found guilty, the goal for the justice system shouldn’t be harsher treatment for white people (bc we will get it even worse) but fairer treatment for us.

612

u/ben10toesdown 20h ago

Not even just likely true. Sentenced to 2 life sentences by the exact same judge.

That trial is being reopened is my understanding based on what transpired in the Clancy trial.

Edit: https://www.nytimes.com/2026/09/03/us/lindsay-clancy-latarsha-sanders-retrial.html

I should have added a source to begin with.

u/surferdude7227 18h ago

Yeah, the judge excluded her mental health evaluations post arrest “unless the prosecution opened that door”.

Judge fucking sucks, but at least they are taking another look at it. She doesn’t need a cell. She needs help.

65

u/happymancry 16h ago

Not mutually exclusive. She should get help but should also stay away from general society if this is what her mental illness can make her do.

82

u/lilbelleandsebastian 14h ago

i mean yeah, whenever someone gets off with an insanity plea that doesn't mean they get released back into gen pop lol

they get put in a state run psych ward for the long haul just like andrea yates

5

u/RaindropBebop 8h ago

In Mass they're evaluated as to whether they're a danger to society or themselves. If not, they're released. The minimum stay before an evaluation is 40 days. I'm sure that's exceedingly rare for patients like this, as the state would petition for extensions, but the fact that it's possible is concerning.

I feel for people with mental health problems, but her command voice defense that only materialized once for a short while to murder her children and never returned, and which she mentioned to no one until the defense lawyer's creepy friend visited her in the hospital days later is too convenient and too flimsy. The fact that the husband had to ask about the children when she was lying outside after the psychosis had reportedly abated, instead of her telling him to check on them and hoping that what she thinks just happened in a psychotic haze didn't just happen is too unbelievable.

I watched the entire trial, and I think she was certainly mentally ill, but absolutely not psychotic. She methodically planned and executed the murders and planned to commit suicide and she deserves jail. It was not an evil voice that took over her body and overpowered her better judgement in a single, impulsive moment of psychosis.

Maybe not life, but in my opinion, she certainly doesn't deserve to possibly be out on the streets in years let alone months.

Based on the other comments in defense of her NGRI plea, I'm expecting to get downvoted to hell, but it is what it is. If they watched the entire trial, then I respect their opinion all the same. That just goes to show how divisive this trial was.

1

u/happymancry 14h ago

If insanity is proven then I’d be ok with that - but then I’d also want all other similar cases - whether the defendant be men/women, black/white, whatever - receiving the same due process.

5

u/lilbelleandsebastian 13h ago

it doesn't matter what you're okay with, that's just literally the law and what happens. you seem like a bot, i mean who is arguing against due process in this thread or anywhere lol

5

u/surferdude7227 14h ago

Oh yeah no, 100%.

Not guilty by reason of insanity just means that the person can get the mental health support they need. They’re still probably going to be locked up for a loooong time.

1

u/Commercial-Co 11h ago

I dont think they should be called Not Guilty by Reason of Insanity - i think it should be Guilty Due to Reasons of Insanity.

And i think even if you’re not going to jail, you should receive a term that you serve out. If “cured” of mental illness, i think you should still serve out the term in a rehab style prison. If not cured, you stay in mental hospital.

u/zefen 20h ago

That’s a whole ass different argument from the conversation at hand and from à comment below, it’s getting addressed (idk if it is tho, I’m busy eating before court)

5

u/Worried_Mirror_355 18h ago

Judge doesn't decide if she's guilty or not though?

5

u/CertainInteraction4 17h ago

Evidence heard can change  the whole reasonable doubt premise though.  Disallowing evidence hinders fairness.

2

u/ben10toesdown 17h ago

Moreso to point out that this case happened in the exact same state/county and not in a completely different state like Texas & what u/CertainInteraction4 noted about evidence.

2

u/JohnnyRelentless 14h ago

The article also includes a black woman who killed her 2 children and who did get found not guilty by reason of insanity and lives in a mental institution.

144

u/Latter-Rooster3563 20h ago

This! Harsher is not the answer. I think all BIPOC should be given as much grace as yt people are.

91

u/jackheavy 20h ago

I agree in principle, but principles aren’t always put into practice. The current practice is that we get harsher punishment. I think enough harsher punishment for white people will eventually result in fairer treatment for us. If the current circumstances have reiterated anything, it’s that white people don’t care until it is happening to them.

49

u/Competitive_Swan_130 15h ago

Why would you believe this when it has never happened before?

4

u/SpaceballDarth 16h ago

Before I add my 2¢, I just want to say that I 100% agree with you. The American justice system has been exposed, for YEARS, as unfair, especially when it comes to BIPOC and wealth. I don’t think harsher sentences for white people is going to correct this, I think it will make it worse for BIPOC. If we ever have a justice system that doesn’t exploit the poor and working class, (which I don’t see happening under capitalism), there may be a chance that could happen. But as long as the racist/bigot/sexist wealthy folks, continue to run the show and write the laws to benefit themselves, it will not be fair.

8

u/Rare-Television-8854 7h ago

Nope. Has little to do with wealth. Upper middle class black and brown folks get railroaded all of the time. I’ve been a lawyer for more than 20 years and am a literal (though low) millionaire, yet I still shudder every time I see a cop in my rear view mirror.

Why? Won’t my wealth, advanced degrees and pedigree/social status get me out of mortal danger because of that whole class-not-race mumbo, jumbo (respectfully) you appear to be blathering on about?

Nope. Cause at the end of the day, the system cares not about my education or net income. (Ask any black person you trust.) It doesn’t check my bank statements and stock portfolio. And if it did, I might actually be in more danger depending on where I happen to be in the country.

It’s not a class thing; it’s a race/racist thing.

4

u/redditizms ☑️ 18h ago

That’s a fact!

2

u/Rare-Television-8854 7h ago edited 7h ago

This.

White people don’t really care and take action until it starts happening to them on a large, system-wide scale.

You’d have to be an absolute racist as a white person to admit or even believe that BIPOC shouldn’t be treated equally under the law after admitting the obvious—i.e., that we aren’t and never have been. But that’s the easy part. It takes virtually no effort at all.

White folks merely acknowledging the obvious problem does nothing for me and other BIPOCs. Empty platitudes don’t achieve justice for all of us under the law.

But let a bunch of white folks start getting treated like black and brown people by the criminal “justice” system and sentenced to football numbers, and then we’ll achieve actual, lasting change.

Until that happens, it’s just more of the same—tantamount to a bunch of “thoughts and prayers” after a mass shooting. 🤷🏾‍♂️

2

u/retrosenescent 13h ago

It especially will have to happen to white women, who currently receive the most lenient sentences out of everyone. White men already receive disproportionately harsh sentences compared to white women, and still nothing is done about it. You have to slaughter the sacred cow.

36

u/Forty86 20h ago

If he held out because of how things would go for another person of a different skin tone or sex, his reasoning makes sense. This does not mean his actions are correct/incorrect. With that being said, if we are only going by the laws/practices that are already put into place, looking at prior planning to kill her children, and sending her husband away while she committed the acts.
That’s premeditated, which means she should be found guilty of capital murder/first degree murder.

TLDR: The justice system needs reformation to help people. However, under the current laws she’s should be found guilty of first degree murder.

Also, don’t feed into the divisive political stances or social wars that cases like this are being used for.

5

u/micro_satsuma 14h ago

There was testimony from an expert that premeditation is still possible while undergoing psychosis, so maybe that alone isn't grounds for conviction because there's still reasonable doubt.

24

u/MutedRage 20h ago

Right or wrong, we only get there if their outcomes look like ours.

11

u/Forty86 20h ago

Peacefully, this is the only way to get there. But you can also get there with civil unrest that isn’t scared of violence.

-1

u/go4urs 19h ago

When/where is proof of this?

1

u/Forty86 17h ago

If you’re asking me for proof of when violence frees the oppressed, I’d suggest opening any history book that talks about Iran, South Africa, U.S., China, Japan. Like idk where to start.

3

u/wafswafs 18h ago

That is not what happens with a hung jury, though. It's a retrial.

3

u/NeverNotOnceEver ☑️ 14h ago

ICE shot and killed a white woman last year. What changes came out of that?

1

u/Dramatic_Explosion 15h ago

Yeah, lots of "should" and "shouldn't" existing in the world right now, especially from the justice system.

Our president shouldn't have raped kids. The DOJ should prosecute him and others for doing it. The Supreme Court shouldn't have said whatever he does is legal.

But we have to live in the world we have. The entire system failed up to the point she killed them, and we're not fixing that either.

u/KingBoyo 20h ago

I’ve been thinking about this a lot. I told my close friends immediately that I couldn’t be on that jury. I think the justice system isn’t nuanced enough to handle this, but I probably would’ve said guilty because I know for a fact black women aren’t getting that same grace and consideration.

78

u/Nightthrasher674 20h ago

I would have said not guilty by reason of insanity. Following the case, the prosecution didn't do enough at all to prove that she wasn't insane and she took every avenue to get psychiatric help before the murders. Removing my own emotions aside it's basically the right thing to do. Clancy has fuck all to do with Latasha Sanders.

It's like the Dejuan Brown stabbing of Iryna Zarutska he's currently committed in a mental facility.

192

u/TonyHawktuah69 19h ago

Her own husband said he didn’t marry a monster, he married a woman who became ill. He’s suing the hospital and her doctors into the ground in a civil suit over how they messed up her meds and evaluations.

By all accounts she loved those kids and her becoming mentally ill to the point she killed them in her psychosis is horrifying. Her mother in law and parents all came to support her during the trial. We have let right wing media talking points politicize a complicated case and it’s resulting in culture war bull shit or people just wanting to see punishment. The reality is the medical system failed this woman like it fails so many other women. And now we are letting the justice system fail her again by dragging this case into public and people wanting to kill and hurt a mentally ill woman just to satisfy their own sense of justice and revenge. The people closest to her and this case don’t even want that

94

u/Nightthrasher674 19h ago

On one hand I can understand the annoyance of Clancy supporters who have turned the case into their own crime podcast and trying to pin it on her husband before the trial even started

At they same time, I don't have shit to do with them. She was clearly going through a psychosis and no other evidence says otherwise. I'm not needlessly putting a man or woman in prison for first degree murder. Clancy going to prison isn't helping out black women.

-26

u/100thBlade 19h ago

She was thinking clearly enough to get her husband out of the house on a pretext.

She was thinking clearly enough to kill the kids one at a time to retain control the situation.

She was thinking clearly enough to inflict superficial wounds on herself to make it look like a suicide attempt, but not deep enough to actually kill.

Idk.

39

u/fennecdore 19h ago

She was thinking clearly enough to get her husband out of the house on a pretext.

She was thinking clearly enough to kill the kids one at a time to retain control the situation.

None of this is out of reach for someone going through psychosis. And that's also assuming that the psychosis didn't start after she sent her husband on an errands. She was routinely left alone with the kids, she didn't have to invent a reason.

She was thinking clearly enough to inflict superficial wounds on herself to make it look like a suicide attempt, but not deep enough to actually kill.

She still went into cardiac arrest, had to receive blood and she will likely spend the rest of her days in a wheelchair. She is alive because she is lucky.

22

u/PoopyButt28000 14h ago

It feels like people are under the impression that someone going through psychosis just becomes an insane monster foaming at the mouth who can't think about anything other than destroying everything in front of them.

3

u/SilntNfrno 7h ago

I was in psychosis for a solid 9 months due to drug abuse and the resulting sleep deprivation. Looking back on it my behavior was absolutely crazy, but at the time I thought I was 100% sane.

-2

u/Income-Rude 10h ago

What evidence would you need to see to be convinced she wasn’t in a psychosis?

Like how can someone prove that she wasn’t? You can’t prove a negative.

You can prove that she was, but you can’t prove that she wasn’t. Theoretically anything is possible and we can’t truly know what was happening in her head.

At some point the heinousness and complexity of the crime has got to inform on her state of mind. Anything is possible and maybe she was in a psychosis, but on some level if she is that functional in her psychosis, maybe it’s not a stretch to expect her to not kill anybody.

-10

u/showerbump 18h ago

didn't she google how to strangle someone in the time leading up to it?

7

u/fennecdore 18h ago

People commit murder-suicides all the time. The intent to kill themselves doesn't automatically absolve them of the murder. Especially when the murder and suicide are both premeditated.

19

u/jayjackalope 18h ago

I used to work in jury services for my local superior court. We always want jurors to admit they cant be unbiased. It's part of the original selection process. Common one was people who were anti death penalty serving where a trial might have that on the table.

Def saw folks lie to get on a jury. One was a dv case. Jurors were asked: "have you or anyone you known ever been impacted by domestic violence? Juror currently had protective order against him for a dv case. Basically, it was still processing and no one caught it before hand. Man lied to get on the jury. No idea why. Whole trial had to be thrown out and had to start all over again with a fresh group of jurors, etc. I personally felt he hated women and just wanted to find another man innocent.

Process is called "voir dire." Basically, jurors have to truthfully state why they cannot be unbiased for a trial. We had a violent child sexual assault/ torture case that was really bad. All the jurors said they couldnt be impartial. When they came back the the jury room many were sobbing uncontrollably. Went thru a month of tissue box supply in one day. I felt so bad for them. I think the perp ended up taking a plea cos his lawyer told him they might never be able to get a jury.

Mad respect to any one on a jury. Especially this one. Im sure they saw images they will never get over. It takes guts to be able to be unbiased. And gut to admit you cant be.

2

u/pan-re 17h ago

Institution or jail?

1

u/der_innkeeper 20h ago

This is an extreme edge case.

I feel for those jurors.

52

u/HairlessHoudini 20h ago

I agree. If she was a black woman that jury would have only been out for an hour and came back guilty

-1

u/KamikazePenguiin 12h ago

That's okay. Had it been a white man or any other man it would've taken less than 13 minutes for a guilty verdict.

18

u/AbyssWankerArtorias 20h ago

Makes sense, but does not make it okay, if what other jurors said is to be believe which is that he literally said "I don't think the prosecution proved that she wasn't in psychosis beyond a reasonable doubt, but I'm still voting guilty."

14

u/McdoManaguer 18h ago

The actual answet is neither should go to prison. Just because there is an injustice towards one race doesnt mean all races should get unjust treatment, it means the race facing injustice should be treated better.

I dont understand how thats complicated.

I’m with you. If he was not at all interested in their opinions, it’s most likely this or even the thought that if it were a man, it would be different. And if so, he’s absolutely right that it would have been different just based on the headline. Disclaimer: I do not at all know the ins and outs of this case.

12

u/midwestprotest 20h ago

How would it have been different? I’m trying to understand what you’re saying / trying to make sure I’m interpreting you correctly.

3

u/Feisty-Honeydew-5309 ☑️ 20h ago

I don’t know all the ins and outs of the case, but there certainly would be much less discourse had it been a different demographic who was tried. What I know about the case is against my will, but it’s mostly from social media and in her defense. I’m a woman though. Might just be my algorithm.

11

u/midwestprotest 20h ago

I still don’t get what you mean - are you saying people are only talking about it because she’s a white woman and so they don’t believe her? Or are you saying she is being given grace because she is a white woman? Or some other thing I’m not picking up on? My only social media is Reddit and Reddit is decidedly against her for reasons I don’t quite understand.

10

u/Feisty-Honeydew-5309 ☑️ 19h ago

If the headline is woman killed child, regardless of why, the amount of defensive discourse would not exist if it were a different demographic.

I was merely speculating and saying if that’s the reason for his decision it makes sense. No slight to anybody just saying I can see how someone might adopt this line of thinking.

1

u/quality-control 13h ago

When we speculate, usually we say things like "maybe this was their reasoning" or "perhaps they were thinking like this" and not "I believe he did that because he's protesting how black women get treated by the criminal justice system". That's gone past speculation and into presumption

1

u/Forty86 13h ago

I keep saying if that’s his line of thinking then I can make sense of it. I don’t agree with it. I’m also not making the assumption for him. Just establishing why I think he might’ve did what he did.

1

u/quality-control 13h ago

I believe his stubbornness has to do with how the trial would go if she were a black woman

1

u/Forty86 13h ago

Idk how to highlight a part of a comment like you did so I just copied it again

…Which isn’t necessarily better than prison forever, but if thats the reason why he refused to change then it makes sense.

1

u/quality-control 13h ago

You are still presuming to understand why this person came to the conclusion that they did when you say "I believe his stubbornness has to do with how the trial would go if she were a black woman". Adding on that you also think it makes sense if someone thinks that way doesn't change that. Its just a roundabout way of saying "I've made up my mind about why this person did this thing and I support it" while having Z E R O information to actually support any conclusion whatsoever

1

u/Forty86 13h ago

I didn’t put the other comment in there before so you wouldn’t have seen it.

I’ve had to copy and paste it over and over because I keep getting replies.

If he held out because of how things would go for another person of a different skin tone or sex, his reasoning makes sense. This does not mean his actions are correct/incorrect. This is a reflection of a faulty justice system because if you can kill anyone unprovoked, there is something wrong with you mentally. The justice system is not designed to treat or rehabilitate anyone, it’s a strict punishment for profit system.

If he held out because of how things would go for another person of a different skin tone or sex,

WHY ARE YOU STILL JUST ASSUMING THAT THIS HAS ANYTHING TO DO WITH THIS? I don't understand how you are not comprehending that coming up with your own headcanon about the motivations of a person that you literally know nothing about at all IS THE ENTIRE FUCKING ISSUE.

1

u/Forty86 13h ago

I’m not saying that why he did it. I’m saying if that’s why he did it, I can understand how he got there.

A correction: If she does get off on the charges (which is what an insanity ruling is--the state is no longer able to legally pursue charges. Her chargers are no longer a consideration in her case at all.) there's no actual legal requirement for her to go to an institution in Massachusetts

She probably will, but technically the judge can only order her to go for a month long evaluation period. And from then on, her psychaitrists have to prove intitally and then annually that Clancy is not only still severely mentally ill, but also prove "beyond a reasonable doubt" to the court that she's a danger to society.

If they can't, she gets released. And theirs will be even more difficult of a "reasonable doubt" than the current prosecutors' because her condition was a temporary post partum psychosis (literally 30 minutes, one and done) which is something her lawyer has been very adamant about driving home, possibly for this reason.

She's in one of the best states for insanity pleas.

u/Themanstall ☑️ BHM Donor 20h ago

She shouldn't be in jail, though. She should be in a mental health facility. which would have happened if she was found not guilty.

White people were letting her off easy. It wasn't a white v. Black case. In that situation, I agree with you. There were many moms on the jury who had reasonable doubt about her mental state.

-1

u/avantvagrant 19h ago

she should be in jail

36

u/AmarantaRWS 19h ago

If you've ever been to a mental health facility for the criminally insane you'd realize jail is probably mercy. Beyond this, justice shouldn't be about societal revenge on people who commit crimes but about the betterment of society.

-3

u/Razatiger 16h ago

This just isn't true, the average stay in a mental health facility is 5-8 years if the person shows great strides of recovery.

The question becomes whether or not a person like her deserves another opportunity, and I would say no. As much as I feel the situation sucks for everyone, you don't deserve to go back into the world after offing 3 people.

And its not like it was a terrible accident, she killed those kids with her bare hands, thats personal on a deep level.

0

u/retrosenescent 13h ago

This is my stance too. Once someone's perception of reality can not be trusted, how could it ever be trusted again. She experienced a false reality with enough belief and conviction to think murdering 3 people was a good decision. She will never be able to know if what she's perceiving is real or not, even if professionals think she's recovered. Being unable to trust your perception of reality is not something that can be recovered from.

18

u/MBDTFTLOPYEEZUS 19h ago

I’m not saying where she should go but a lot of people don’t realize prison would literally be better. You can at least socialize with normal people, get some cigs and weed, maybe she joins a gang. In a psych ward she’s isolated in mandatory therapy and probably never make any progress because she’s not gonna stop being suicidal.

-2

u/FreddyUnderhill 13h ago

she brutally murdered her 3 children with her own hands. prison would definitely not be better for her, the other prisoners would make sure of that and the guards wouldn't stop them.

7

u/MBDTFTLOPYEEZUS 13h ago

Vigilante prison justice is alot more prevalent on Reddit than reality buddy. A lot of woman are in prison for killing kids and aren’t getting shanked.

Also she tried to kill herself she likely wants to die, so regardless prison is a better ending for what she wants.

-3

u/FreddyUnderhill 12h ago

Also she tried to kill herself she likely wants to die

she doesn't have any regrets about her actions. she doesn't feel guilty, she believes she deserves to be free. she's not even going to spend the rest of life in a mental hospital, she'll be released in under a year since she is no longer showing any signs of psychosis.

3

u/MBDTFTLOPYEEZUS 12h ago

I doubt it

1

u/avantvagrant 9h ago

sounds like a reasonable doubt to me

9

u/brinz1 18h ago

At the end of the day, the trial was always going to decide the colour of the jumpsuit she shits herself in for the rest of her life

-2

u/CrazyinLull 19h ago

She was already seeing mental health professionals and this still happened. She was being prescribed medications, not taking them, and this still happened. Like, I am more than willing to bet that if she went to a mental health facility, she would manage to get out early.

-9

u/BlueHaze464 18h ago

The mental facility is just an excuse to release her in less than a year

She no longer has any mental illness to treat that hasn't been treated the past 3 years

u/Stermo28 17h ago

Sorry but this is just nonsense

yes a racist person would purposely do something to hurt a member of a different race

but a group of white people obviously don´t have a reason to help a white person when everyone involved in the case was also white (why would they protect a white mother, when literally 3 WHITE children were murdered)

White people from predominantly white countries especially "very white" European countries cannot view the world through the lenses of "If the person is white, I am gonna be nicer to them" because pretty every person they know is white

Every good person they know is white, the worst person they know is white, their friends are white, their boss is white... - "whiteness" cannot be a metric for them because majority of their life decisions involve white people only so they need a more of specific metric

But like I said that only goes if it is a case ONLY involving white people the moment other races are involved then obviously there is a chance that racism could play a role

2

u/Key_Strawberry_381 16h ago

Only racist people do what you talking about. Maybe that's why I get dismissed for jury duty cause I ain't protecting shit just cause you same skin tone as me.

I think his refusal to shift his beliefsis because he hates women and lied on his application. He has a history of domestic violence against women AND children and an active restraining order in place. (This is brand new information coming out)

Went to the comment section of good morning america and one of the Jurors said the guy was black to Gayle King. All Galyle said was that she needed to process that for a second.

Top liked comment was “Gayle is racist”. These people are not fucking serious

1

u/pan-re 17h ago

She would have been sent either to jail or stay in an institution like she has been. She wasn’t going to be declared innocent. Gotten through to where?

1

u/demonotreme 16h ago

But...the dead kids are white, too

1

u/Epstein_Bros_Bagels 16h ago

I remember seeing a study once that says black judges actually give harsher sentences to black criminals cause "you should know better" and "you hurt the community" thinking

1

u/Atralis 15h ago

I was on a hung jury with a black defendant and the one black guy was voting for guilty along with about half the jury. I actually noticed an effect where women and older people were more likely to go with not guilty.

1

u/Dull_Wind6642 14h ago

Thats not true for white people. I don't know any white people that cares about other white or have that feeling of brotherhood.

You can even look at studies, in fact they will side more often with minorities than people with the same skin color

1

u/AnnualLetterhead1027 14h ago

Ok. Again. The jurors were voting for not guilty BY REASON OF INSANITY.

1

u/Forty86 13h ago

Yeah, if found not guilty she goes to a psych ward for life. If found guilty she goes to prison for life. No one wins in either case.
