While likely true about a black woman being found guilty, the goal for the justice system shouldn’t be harsher treatment for white people (bc we will get it even worse) but fairer treatment for us.
In Mass they're evaluated as to whether they're a danger to society or themselves. If not, they're released. The minimum stay before an evaluation is 40 days. I'm sure that's exceedingly rare for patients like this, as the state would petition for extensions, but the fact that it's possible is concerning.
I feel for people with mental health problems, but her command voice defense that only materialized once for a short while to murder her children and never returned, and which she mentioned to no one until the defense lawyer's creepy friend visited her in the hospital days later is too convenient and too flimsy. The fact that the husband had to ask about the children when she was lying outside after the psychosis had reportedly abated, instead of her telling him to check on them and hoping that what she thinks just happened in a psychotic haze didn't just happen is too unbelievable.
I watched the entire trial, and I think she was certainly mentally ill, but absolutely not psychotic. She methodically planned and executed the murders and planned to commit suicide and she deserves jail. It was not an evil voice that took over her body and overpowered her better judgement in a single, impulsive moment of psychosis.
Maybe not life, but in my opinion, she certainly doesn't deserve to possibly be out on the streets in years let alone months.
Based on the other comments in defense of her NGRI plea, I'm expecting to get downvoted to hell, but it is what it is. If they watched the entire trial, then I respect their opinion all the same. That just goes to show how divisive this trial was.
If insanity is proven then I’d be ok with that - but then I’d also want all other similar cases - whether the defendant be men/women, black/white, whatever - receiving the same due process.

well i mean dads cannot experience post-partum psychosis which is the crux of this entire trial. also, yes black women are treated horribly in basically every institutional system, why is that a reason to be harsher than you should be situationally instead of more fair in the future to all?
also, i don’t understand why people think she’d go free with a successful insanity plea at all. it’s literally just determining whether you’ll spend your sentence in a psych hospital (given the attempt to treat mental illness) or a prison, which would create compounding issues in the future especially in the case of psychosis-related issues.
Is post partum psychosis the only kind of mental health crisis “allowed”? If so, why?
If you believe in legal precedent, wouldn’t that mean that the history of punishment meted out to men and black women for similar crimes has set a legal standard - and by that measure, Clancy is getting off easier? Sending her to prison or death row would actually be “at par” - anything less is leniency.
This is not about a single woman any more. If it were, it wouldn’t be anything more than tabloid news. This is a chance to re-examine what we’ve come to accept as normal. It’s a chance to ask why certain communities are given more grace and understanding than others. It’s the only way we make progress - regardless of how uncomfortable it makes you.
i am really confused as to your point here. the clancy case is not public opinion based, it is a court case which is using evidence and verifiable facts to determine the truth. from there, it can be a precedent to study and provide additional attention to parental mental health and should the insanity plea hold up, it’s possible for old cases to be reopened, thus evaluated more fairly.
injustice against one group is not justification to commit more injustice against another, injustice is something which should be actively opposed at all angles; dismissing one injustice in the face of another helps nobody.
other mental health conditions are valid, obviously? but the clancy trial isn’t about a different mental health condition, it is about post partem psychosis.
Not guilty by reason of insanity just means that the person can get the mental health support they need. They’re still probably going to be locked up for a loooong time.
I dont think they should be called Not Guilty by Reason of Insanity - i think it should be Guilty Due to Reasons of Insanity.
And i think even if you’re not going to jail, you should receive a term that you serve out. If “cured” of mental illness, i think you should still serve out the term in a rehab style prison. If not cured, you stay in mental hospital.
