I believe his stubbornness has to do with how the trial would go if she were a black woman. More than likely she would go to prison without a second thought, but in this case she could go to a psych ward for life. Which isn’t necessarily better than prison forever, but if thats the reason why he refused to change then it makes sense.

I appreciate the awards yall but this is just me trying to make sense of his position. Do not take it as fact. I’d prefer if we’d focus on fixing the system that has failed so many.

While likely true about a black woman being found guilty, the goal for the justice system shouldn’t be harsher treatment for white people (bc we will get it even worse) but fairer treatment for us.

Yeah, the judge excluded her mental health evaluations post arrest “unless the prosecution opened that door”.

Judge fucking sucks, but at least they are taking another look at it. She doesn’t need a cell. She needs help.

In Mass they're evaluated as to whether they're a danger to society or themselves. If not, they're released. The minimum stay before an evaluation is 40 days. I'm sure that's exceedingly rare for patients like this, as the state would petition for extensions, but the fact that it's possible is concerning.

I feel for people with mental health problems, but her command voice defense that only materialized once for a short while to murder her children and never returned, and which she mentioned to no one until the defense lawyer's creepy friend visited her in the hospital days later is too convenient and too flimsy. The fact that the husband had to ask about the children when she was lying outside after the psychosis had reportedly abated, instead of her telling him to check on them and hoping that what she thinks just happened in a psychotic haze didn't just happen is too unbelievable.

I watched the entire trial, and I think she was certainly mentally ill, but absolutely not psychotic. She methodically planned and executed the murders and planned to commit suicide and she deserves jail. It was not an evil voice that took over her body and overpowered her better judgement in a single, impulsive moment of psychosis.

Maybe not life, but in my opinion, she certainly doesn't deserve to possibly be out on the streets in years let alone months.

Based on the other comments in defense of her NGRI plea, I'm expecting to get downvoted to hell, but it is what it is. If they watched the entire trial, then I respect their opinion all the same. That just goes to show how divisive this trial was.

If insanity is proven then I’d be ok with that - but then I’d also want all other similar cases - whether the defendant be men/women, black/white, whatever - receiving the same due process.

Not guilty by reason of insanity just means that the person can get the mental health support they need. They’re still probably going to be locked up for a loooong time.

I dont think they should be called Not Guilty by Reason of Insanity - i think it should be Guilty Due to Reasons of Insanity.

And i think even if you’re not going to jail, you should receive a term that you serve out. If “cured” of mental illness, i think you should still serve out the term in a rehab style prison. If not cured, you stay in mental hospital.

I agree in principle, but principles aren’t always put into practice. The current practice is that we get harsher punishment. I think enough harsher punishment for white people will eventually result in fairer treatment for us. If the current circumstances have reiterated anything, it’s that white people don’t care until it is happening to them.

Before I add my 2¢, I just want to say that I 100% agree with you. The American justice system has been exposed, for YEARS, as unfair, especially when it comes to BIPOC and wealth. I don’t think harsher sentences for white people is going to correct this, I think it will make it worse for BIPOC. If we ever have a justice system that doesn’t exploit the poor and working class, (which I don’t see happening under capitalism), there may be a chance that could happen. But as long as the racist/bigot/sexist wealthy folks, continue to run the show and write the laws to benefit themselves, it will not be fair.

Nope. Has little to do with wealth. Upper middle class black and brown folks get railroaded all of the time. I’ve been a lawyer for more than 20 years and am a literal (though low) millionaire, yet I still shudder every time I see a cop in my rear view mirror.

Why? Won’t my wealth, advanced degrees and pedigree/social status get me out of mortal danger because of that whole class-not-race mumbo, jumbo (respectfully) you appear to be blathering on about?

Nope. Cause at the end of the day, the system cares not about my education or net income. (Ask any black person you trust.) It doesn’t check my bank statements and stock portfolio. And if it did, I might actually be in more danger depending on where I happen to be in the country.

It’s not a class thing; it’s a race/racist thing.

White people don’t really care and take action until it starts happening to them on a large, system-wide scale.

You’d have to be an absolute racist as a white person to admit or even believe that BIPOC shouldn’t be treated equally under the law after admitting the obvious—i.e., that we aren’t and never have been. But that’s the easy part. It takes virtually no effort at all.

White folks merely acknowledging the obvious problem does nothing for me and other BIPOCs. Empty platitudes don’t achieve justice for all of us under the law.

But let a bunch of white folks start getting treated like black and brown people by the criminal “justice” system and sentenced to football numbers, and then we’ll achieve actual, lasting change.

Until that happens, it’s just more of the same—tantamount to a bunch of “thoughts and prayers” after a mass shooting. 🤷🏾‍♂️

If he held out because of how things would go for another person of a different skin tone or sex, his reasoning makes sense. This does not mean his actions are correct/incorrect. This is a reflection of a faulty justice system because if you can kill anyone unprovoked, there is something wrong with you mentally. The justice system is not designed to treat or rehabilitate anyone, it’s a strict punishment for profit system.

With that being said, if we are only going by the laws/practices that are already put into place, looking at prior planning to kill her children, and sending her husband away while she committed the acts.
That’s premeditated, which means she should be found guilty of capital murder/first degree murder.

TLDR: The justice system needs reformation to help people. However, under the current laws she’s should be found guilty of first degree murder.

Also, don’t feed into the divisive political stances or social wars that cases like this are being used for.

Yeah, lots of "should" and "shouldn't" existing in the world right now, especially from the justice system.

Our president shouldn't have raped kids. The DOJ should prosecute him and others for doing it. The Supreme Court shouldn't have said whatever he does is legal.

But we have to live in the world we have. The entire system failed up to the point she killed them, and we're not fixing that either.

I’ve been thinking about this a lot. I told my close friends immediately that I couldn’t be on that jury. I think the justice system isn’t nuanced enough to handle this, but I probably would’ve said guilty because I know for a fact black women aren’t getting that same grace and consideration.

I would have said not guilty by reason of insanity. Following the case, the prosecution didn't do enough at all to prove that she wasn't insane and she took every avenue to get psychiatric help before the murders. Removing my own emotions aside it's basically the right thing to do. Clancy has fuck all to do with Latasha Sanders.

It's like the Dejuan Brown stabbing of Iryna Zarutska he's currently committed in a mental facility.

Her own husband said he didn’t marry a monster, he married a woman who became ill. He’s suing the hospital and her doctors into the ground in a civil suit over how they messed up her meds and evaluations.

By all accounts she loved those kids and her becoming mentally ill to the point she killed them in her psychosis is horrifying. Her mother in law and parents all came to support her during the trial. We have let right wing media talking points politicize a complicated case and it’s resulting in culture war bull shit or people just wanting to see punishment. The reality is the medical system failed this woman like it fails so many other women. And now we are letting the justice system fail her again by dragging this case into public and people wanting to kill and hurt a mentally ill woman just to satisfy their own sense of justice and revenge. The people closest to her and this case don’t even want that

On one hand I can understand the annoyance of Clancy supporters who have turned the case into their own crime podcast and trying to pin it on her husband before the trial even started

At they same time, I don't have shit to do with them. She was clearly going through a psychosis and no other evidence says otherwise. I'm not needlessly putting a man or woman in prison for first degree murder. Clancy going to prison isn't helping out black women.

I used to work in jury services for my local superior court. We always want jurors to admit they cant be unbiased. It's part of the original selection process. Common one was people who were anti death penalty serving where a trial might have that on the table.

Def saw folks lie to get on a jury. One was a dv case. Jurors were asked: "have you or anyone you known ever been impacted by domestic violence? Juror currently had protective order against him for a dv case. Basically, it was still processing and no one caught it before hand. Man lied to get on the jury. No idea why. Whole trial had to be thrown out and had to start all over again with a fresh group of jurors, etc. I personally felt he hated women and just wanted to find another man innocent.

Process is called "voir dire." Basically, jurors have to truthfully state why they cannot be unbiased for a trial. We had a violent child sexual assault/ torture case that was really bad. All the jurors said they couldnt be impartial. When they came back the the jury room many were sobbing uncontrollably. Went thru a month of tissue box supply in one day. I felt so bad for them. I think the perp ended up taking a plea cos his lawyer told him they might never be able to get a jury.

Mad respect to any one on a jury. Especially this one. Im sure they saw images they will never get over. It takes guts to be able to be unbiased. And gut to admit you cant be.

The same judge presided over a similar case with a black female defendant.  The BW's medical records (mental) were not allowed to be read in the courtroom.  Lindsay's were.  The case is being revisited.

When we speculate, usually we say things like "maybe this was their reasoning" or "perhaps they were thinking like this" and not "I believe he did that because he's protesting how black women get treated by the criminal justice system". That's gone past speculation and into presumption

A correction: If she does get off on the charges (which is what an insanity ruling is--the state is no longer able to legally pursue charges. Her chargers are no longer a consideration in her case at all.) there's no actual legal requirement for her to go to an institution in Massachusetts

She probably will, but technically the judge can only order her to go for a month long evaluation period. And from then on, her psychaitrists have to prove intitally and then annually that Clancy is not only still severely mentally ill, but also prove "beyond a reasonable doubt" to the court that she's a danger to society.

If they can't, she gets released. And theirs will be even more difficult of a "reasonable doubt" than the current prosecutors' because her condition was a temporary post partum psychosis (literally 30 minutes, one and done) which is something her lawyer has been very adamant about driving home, possibly for this reason.

She's in one of the best states for insanity pleas.

but a group of white people obviously don´t have a reason to help a white person when everyone involved in the case was also white (why would they protect a white mother, when literally 3 WHITE children were murdered)

White people from predominantly white countries especially "very white" European countries cannot view the world through the lenses of "If the person is white, I am gonna be nicer to them" because pretty every person they know is white

Every good person they know is white, the worst person they know is white, their friends are white, their boss is white... - "whiteness" cannot be a metric for them because majority of their life decisions involve white people only so they need a more of specific metric

But like I said that only goes if it is a case ONLY involving white people the moment other races are involved then obviously there is a chance that racism could play a role

I think his refusal to shift his beliefsis because he hates women and lied on his application. He has a history of domestic violence against women AND children and an active restraining order in place. (This is brand new information coming out)

This is a copy paste thing I made because I got too many replies where I’d have to retype the same thing over and over. I’m not dissing anybody or tryna be funny.

If he held out because of how things would go for another person of a different skin tone or sex, his reasoning makes sense. This does not mean his actions are correct/incorrect. This is a reflection of a faulty justice system because if you can kill anyone unprovoked, there is something wrong with you mentally. The justice system is not designed to treat or rehabilitate anyone, it’s a strict punishment for profit system.

With that being said, if we are only going by the laws/practices that are already put into place, looking at prior planning to kill her children, and sending her husband away while she committed the acts.
That’s premeditated, which means she should be found guilty of capital murder/first degree murder.

TLDR: The justice system needs reformation to help people. However, under the current laws she’s should be found guilty of first degree murder.

Also, don’t feed into the divisive political stances or social wars that cases like this are being used for.

I was on a hung jury with a black defendant and the one black guy was voting for guilty along with about half the jury. I actually noticed an effect where women and older people were more likely to go with not guilty.

You can even look at studies, in fact they will side more often with minorities than people with the same skin color

It’s just a perfect case for the moment. Men vs woman. Black vs white right before elections. Everybody keep their head up. Its Agit prop. None of this has to do with the price of diesel being at record highs, inflation, constant corruption and back dealings etc. their fleecing us while we argue about a dude who did a thing.

Yeah, this was staged as a distraction. And a high profile case of a woman who murdered her three kids then blamed the medical industry for letting her down due to psychiatric issues a substantial amount of the population will deal with at some point is in no way relevant to society or a reflection of its current status/health. 

Surely it’s impossible for me to have opinions on it and the Iran war at the same time.

There's a conversation going around that suggests that if the woman was black or was a black young black man, they wouldn't be getting the same level of support as this white woman. Black people have been sent to jail for less. There's nuance in this case, but it's the internet.

Selecting a jury is a science, it’s an art. Having to know why and how a single person will vote, is up the same alley as profiling a killer.

Marsha Clark is the best example I can give you. She prosecuted OJ. Marsha’s best quality in the courtroom, was that even as a white woman during the race riots in a California, black women responded to her very well PRIOR to the OJ trial. The Keyword is PRIOR.

Her aim for the OJ case was to get as many black females on the jury as possible.

While Johnnie Cochran was the star of the defense, it was really Carl E. Douglas that strategized the jury selection. Carl E. Douglas is an African American man and as an African American man in the 90’s, he knew that African American females were MORE likely to vote “not guilty” for a MALE African American defendant, because African American women, at that time in the 90’s, heavily valued watching, helping and witnessing an African American man becoming and staying successful.

He also thought that African American women would see Marsha Clark as “aggressive”, and it turns out if you let a white woman terribly misrepresent a case that was fueled by racism, that is true.

You can win a trial during jury selection. It’d be the equivalent of pitching a “perfect game”.

I know I’m gonna get downvoted and yelled at, but before doing so, please at least check out the book “Without a Doubt”. It’s a memoir written by Marsha Clark that describes her failure in the jury selection process.

Who wants to be the judge who removed the only black juror to get a whites woman off killing her kids? I think the judge covered his ass there. And frankly, I’m not sure how so many people are convinced she was insane.
